Terms of Service

Please read these Terms of Service ("Terms") carefully before using massrealtyinc.ca (the "Site"), operated by Mass Realty Inc. ("Mass Realty," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Mass Realty Inc.

Mass Realty Inc. is a boutique, technology-forward real estate brokerage registered in the Province of Ontario. We combine in-house staging, legal, marketing, and negotiation expertise with proprietary technology tools to serve buyers, sellers, and investors across the Greater Toronto Area. Our platform is built to make the real estate process more transparent, efficient, and accessible.

We are a member brokerage of the Toronto Regional Real Estate Board (TRREB) and are registered with the Real Estate Council of Ontario (RECO).

2. Third-Party Listings and Agent Affiliations

The Site may display property listings submitted by agents who have been granted access to the Mass Realty platform. The presence of a listing on this Site does not mean that the listing agent is a Mass Realty employee, partner, or affiliated agent. Agents with portal access are independent and are solely responsible for the accuracy and completeness of the listings they submit.

Mass Realty makes no representations or warranties regarding listings submitted by third-party agents, including but not limited to the accuracy of pricing, property details, availability, or legal status of any property.

3. No Client-Agent Relationship

Using this Site, browsing listings, submitting a contact form, or interacting with any feature of the platform does not create a client-agent relationship between you and Mass Realty Inc. or any agent affiliated with the platform. A formal working relationship is only established through a written representation agreement signed by both parties in accordance with Ontario real estate regulations.

Nothing on this Site constitutes an offer of representation, a binding commitment to provide services, or any form of legal, financial, or contractual obligation on the part of Mass Realty or its agents.

4. Mortgage Calculator

The mortgage calculator provided on the Site is for illustrative and educational purposes only. Calculations are based on Canadian mortgage conventions (semi-annual compounding) and user-entered inputs. Results do not represent a mortgage offer, pre-approval, rate guarantee, or commitment of any kind from any lender. Actual mortgage payments, insurance premiums, and qualification criteria vary significantly based on individual financial circumstances and lender policies. You should consult a licensed mortgage broker or financial advisor before making borrowing decisions.

5. Home Valuation Estimates

The home valuation tool generates estimates based on property type, size, location, and self-reported upgrades. These estimates are rough approximations only and do not constitute a Comparative Market Analysis (CMA), a formal property appraisal, or a guaranteed sale price. Mass Realty makes no representations about the accuracy of valuation estimates, and no legal reliance should be placed on them. A licensed appraiser or real estate professional should be consulted for any formal valuation.

6. Member Accounts and VOW Data Access

The Site offers a free member account that provides access to a personal portal and, where applicable, listing data made available under a Virtual Office Website (VOW) agreement with PropTX and the Toronto Regional Real Estate Board (TRREB).

By creating an account, you agree that:

• Any sold listing data, price history, or market intelligence accessed through your member account is for your personal, non-commercial use only, as required by the PropTX VOW agreement.
• You will not reproduce, distribute, publish, or share VOW-sourced data with any third party.
• You will not use VOW data to build competing tools, databases, or services.
• Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your login credentials.
• Mass Realty reserves the right to suspend or terminate accounts that violate these terms or the VOW agreement without prior notice.

Creating an account does not establish a client-agent relationship. See Section 3 for details.

7. Minimum Terms of Use — PropTX VOW Requirements

The following terms are required by PropTX's MLS® Rules and Policies and apply to all Members accessing VOW data through this Site.

A Member's VOW must obtain the identity of each Consumer and obtain each Consumer's agreement to Terms of Use of the VOW, as follows:

(a) Consumers must provide their name and a valid email address. The Member must send an email to the address provided by the Consumer confirming that the Consumer has agreed to the Terms of Use (described in paragraph 7(c) below). The Consumer may be permitted to access the VOW only after the Member has verified that the email address provided is valid and that the Consumer agreed to the Terms of Use.

(b) The Consumer must supply a username and a password, the combination of which must be different from those of all other Consumers on the VOW, before being permitted to search and retrieve Listing Information via the VOW. The username and password may be established by the Consumer or may be supplied by the Member, at the option of the Member. An email address may be associated with only one username and password. Consumers' passwords may be valid for up to 90 days, after which such passwords must be renewed or reconfirmed. The Member must, at all times, maintain a record of the name and email address supplied by the Consumer, and the username and current password of each Consumer. Such records must be kept for not less than 180 days after the expiration of the validity of the Consumer's password. If PropTx has reason to believe that a Member's VOW has been the cause of, or permitted a breach in, the security of the MLS® data or a violation of this VOW Policy, or the MLS® Rules and Policies (including the VOW Rules) related to use by one or more Consumers, the Member shall, upon request of PropTx, provide to PropTx a copy of the record of the name, email address, username, current password, and audit trail, if required, of any Consumer identified by PropTx to be suspected of involvement in the breach or violation.

(c) The Consumer must be required to affirmatively express agreement to a "Terms of Use" agreement that requires the Consumer to open and review an agreement that provides at least the following:

• (i) That the Consumer acknowledges entering into a lawful broker-consumer relationship with the Member.
• (ii) That all MLS® data obtained from the VOW is intended only for the Consumer's personal, non-commercial use.
• (iii) That the Consumer has a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the VOW.
• (iv) That the Consumer will not copy, redistribute, retransmit, or otherwise use any of the data or Listing Information provided, except in connection with the Consumer's consideration of the purchase, sale, or lease of an individual property.
• (v) That the Consumer acknowledges PropTx's ownership of, and the validity of PropTx's proprietary rights and copyright in the MLS® database, MLS® data, PropTx's MLS® System, and Listing Information.
• (vi) That the Consumer will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any Listing Information to another individual or entity. The prohibited uses expressly include "scraping" (including "screen scraping" and "database scraping"), "data mining" or any other activity intended to collect, store, re-organize, summarize or manipulate any Listing Information or any related data.
• (vii) After the Consumer has opened for viewing the Terms of Use agreement, a "mouse click" is sufficient to acknowledge agreement to those terms. The Terms of Use agreement may not impose a financial obligation on the Consumer or create any representation agreement between the Consumer and the Member.
• (viii) The Terms of Use agreement shall also expressly authorize PropTx, and other PropTx Members or their duly authorized representatives, to access the VOW for the purposes of verifying compliance with MLS® Rules and Policies (including the VOW Rules) and monitoring the display of Members' Listings by the VOW.
• (ix) Every VOW must display a privacy policy that boldly informs Consumers of, and obtains Consumers' consent to, all the ways in which Personal Information that they provide may be collected, used or disclosed, including the fact that Personal Information may be shared with PropTx for auditing and/or legal purposes.

8. Property Search

Property search results on the Site are drawn from listings sourced through Mass Realty's membership with the Toronto Regional Real Estate Board (TRREB) and PropTX. Search results may be incomplete, may not reflect all available properties in a given area, and may include listings that are no longer active. Mass Realty does not guarantee the accuracy, completeness, or real-time currency of search results.

9. Informational Content and Blog

Articles, guides, and other content published on the Site are for general informational purposes only. They do not constitute legal, financial, tax, or investment advice. Real estate law, tax rules, and market conditions change frequently. Always consult a qualified professional before acting on any information found on this Site.

10. Intellectual Property

All content on the Site, including but not limited to text, design, code, logos, graphics, and the Mass Realty brand identity, is the property of Mass Realty Inc. and is protected under applicable Canadian copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our express written consent.

Property listing content, including descriptions and photos submitted by third-party agents, remains the property of the respective submitting party. Mass Realty assumes no ownership over third-party-submitted content.

11. Accuracy of Information

While we strive to keep content current and accurate, Mass Realty makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of any information on the Site. Property details, pricing, availability, and project information are subject to change without notice. Mass Realty is not responsible for errors or omissions in listing data, pricing, or project details.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Mass Realty Inc., its officers, directors, agents, and technology providers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site or reliance on any information, tool, or content provided herein. This includes, without limitation, damages arising from reliance on valuation estimates, calculator outputs, or third-party listing data.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services. These links are provided for convenience only. Mass Realty has no control over and assumes no responsibility for the content, privacy practices, or terms of any third-party site. Accessing a third-party link is done entirely at your own risk.

14. Acceptable Use

You agree not to use the Site to:

• Submit false, misleading, or fraudulent information through any form or portal.
• Attempt to gain unauthorized access to any portion of the platform.
• Scrape, copy, or systematically extract data from the Site without permission.
• Violate any applicable federal, provincial, or local law or regulation.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be reflected by an updated effective date. Continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
